Title: Investigate Prop 8 – Dialysis Clinics

1. WHEREAS: The Associated Students, Inc. (AS) is the official voice of over 38,000 students at California State University Northridge; AND

2. WHEREAS: AS is the primary advocate for students at CSUN and provides excellent, meaningful programs and services designed to create and enhance a spirited, learning focused campus environment; AND

3. WHEREAS: AS is always trying to get more students involved and increase student participation within the many programs and services we offer; AND

4. WHEREAS: Prop 8 regulates the amount outpatient kidney dialysis clinics charge for dialysis treatment; AND

5. WHEREAS: Prop 8 limits the charges to 115 percent of the costs for direct patient care and quality improvement costs, including training, patient education, and technology support; AND

6. WHEREAS: Prop 8 would require chronic dialysis centers (CDC) to pay interest on the rebate amounts, calculated from the date of payment for treatment; AND

7. WHEREAS: Paying rebates in the amount of excess would significantly reduce the revenues of CDC owner/operators, in the case of CDCs operated by forprofit entities (the majority of CDCs) this means the CDCs would be less profitable or could even be unprofitable; AND

8. WHEREAS In response to the rebate requirements, CDCs could increased allowable costs, reduce other costs, seek adjustments to revenue cap, or scale back operations, resulting in the closure of some CDCs if the amount of required rebates is large and reduced revenues do not provide sufficient return on investment to expand or remain in the market; THEREFORE LET IT BE RESOLVED

1. RESOLVED: That the Associated Students strongly opposes the provisions of Proposition 8-Regulation of Kidney Dialysis Clinics, that limits revenue collected by CDCs, dangerously reducing access to care and places vulnerable patients at serious risk; AND LET IT BE FURTHER

2. RESOLVED: AS encourages all students, faculty, staff, and administration to oppose Proposition 8 and vote no; AND LET IT BE FINALLY

3. RESOLVED: That copies of this resolution be distributed widely, including but not limited to the following: • Governor Jerry Brown • Councilman Mitch Englander • Mayor Eric Garcetti • Democratic Party of San Fernando Valley • The American Nurses Association\California • Dianne Harrison, CSUN President • CSUN Today • The Daily Sundial
